Could you confirm whether Point 3.3 « Personal requirements » of the specifications asks the right information and that the following skills are part of requirements of the team for this tender on cultural web platforms:- In-depth knowledge of ICT policy issues at European level; - Good knowledge of the European Union education, training and life long learning policies and of the Lisbon strategy as well as of broader, related developments in these fields at EU and international levels.

Yes, these are part of the recommanded skills and experience that the team proposed by the tenderer should have.

Question:

In the Terms of Reference, "3.4. – Deliverables, 5. – Workshop", it is requested from the future contractor to organize a one-day workshop. Will the European Commission or the contractor cover the following costs : - Catering/lunch - Transport and accommodation of participants - Production of workshop material (layout/print).

Answer:

It is up to the tenderer to organize the workshop, taking into account the budget refered to under section 3.5.

Question:

Are the following calls for tender also directed to nonprofit organisations (such as foundations)? I did not find a specification of eligible participants in the documents.

Please find the information requested under article 116.6  of the Implementing rules related to  the article 88 of the financial regulation applicable to the general budget of the European Communities.   Article 116.6 Implementing rules  :ELIGIBLE PARTICIPANTS  6. The terms «contractor», «supplier» and «service provider» refer to any natural or legal person or public entity or consortium of such persons and/or bodies which offers to execute works, supply products and provide services respectively. The terms «economic operator» covers «contractors», «suppliers» and «service providers». Economic operators who have submitted a tender are referred to as «tenderers». Those who have asked to be allowed to take part in a restricted procedure, a competitive dialogue, or a negotiated procedure are referred to as «candidates».

Consortia of economic operators shall be authorised to submit tenders or to be candidates. Contracting authorities may not demand that consortia must have a given legal form in order to be allowed to submit a tender or request to take part, but the consortium selected may be required to adopt a given legal form after it has been awarded the contract if this change is necessary for proper performance of the contract.

En réponse à votre question, veuillez trouver l'article 116.6 des modalités d'excécution de l'article 88 du règlement financier applicable au budget général des Communautés européennes. Article 116.6   Modalités d'exécution : PARTICIPANTS ELIGIBLES 6. Les termes «entrepreneur», «fournisseur» et «prestataire de services» désignent toute personne physique ou morale ou entité publique ou groupement de ces personnes et/ou organismes qui offre, respectivement, la réalisation de travaux et/ou d’ouvrages, des produits ou des services sur le marché. Le terme « opérateur économique » couvre à la fois les notions d’entrepreneur, fournisseur et prestataire de services. L’opérateur économique qui a présenté une offre est désigné par le mot "soumissionnaire". Celui qui a sollicité une invitation à participer à une procédure restreinte, à un dialogue compétitif ou à une procédure négociée est désigné par le terme "candidat".

Les groupements d'opérateurs économiques sont autorisés à soumissionner ou à se porter candidats. Pour la présentation d'une offre ou d'une demande de participation, les pouvoirs adjudicateurs ne peuvent exiger que les groupements d'opérateurs économiques aient une forme juridique déterminée, mais le groupement retenu peut être contraint de revêtir une forme juridique déterminée lorsque le marché lui a été attribué, dans la mesure où cette transformation est nécessaire pour la bonne exécution du marché.
